Clinical Negligence ATE Insurance

MedicATE cover has been specifically designed for clinical negligence cases. MedicATE cover offers approved cases insurance cover (typically up to £2,000) for the investigation phase of clinical negligence cases in conjunction with an appropriate level of indemnity post-investigation to run the case to its conclusion.

In addition to cover for the investigation phase we have an expert medical assessor who can provide advice all at no cost to your practice. You can even email our expert medical assessor for advice on the merits of the case as soon as you have had the initial contact with the client.

After that initial email all we need to evaluate your case pre-investigation is:

  1. A completed MedicATE cover application form below;
  2. A brief case summary: relevant pre-incident medical history; dates and facts alleged to constitute negligence (breach of duty and causation); an account of an adverse outcome or a recognised complication of treatment is not sufficient;
  3. Evidence: an extract of the medical records and/or proposed defendant's response to a letter of complaint to substantiate the facts alleged to constitute negligence;

At the end of the investigation stage we re-evaluate the case. If the case has ongoing merits the case simply continues, if we consider that the case does not have ongoing merits (or is not suitable for any reason) and we are unable to offer ongoing cover then our insurer will pay your insured client's disbursements reasonably incurred providing they are within the specified level of cover for the investigation phase.
